Luego de verificar que la controversia entre los despachos judiciales giró en torno a la determinación del factor territorial para establecer el funcionario competente para conocer y decidir la segunda instancia de la acción de tutela formulada, consideró la Corte que debía aplicar el principio perpetuatio jurisdictionis y, en consecuencia, remitir el expediente al Tribunal mencionado para que de forma inmediata continuara con el trámite de la impugnación

- Primero. DEJAR SIN EFECTOS el auto del 9 de diciembre de 2016, por medio del cual, la Sala de Decision Constitucional del Tribunal Superior de Medellin decreto la nulidad de todo lo actuado en la accion de tutela presentada por el senor Jose Humberto Tejada Roman en contra de la Gobernacion de Antioquia.
- Segundo. REMITIR el expediente de la referencia a Sala de Decision Constitucional del Tribunal Superior de Medellin, para que tramite y decida la impugnacion interpuesta por el accionante en contra del fallo de 27 de octubre de 2016 proferido por el Juzgado Veintitres (23) Penal del Circuito con Funciones de Conocimiento de Medellin.
- Tercero. Por Secretaria General, COMUNICAR al Juzgado Veintitres (23) Penal del Circuito con Funciones de Conocimiento de Medellin, y a las partes, el contenido de esta decision.
